Ministeriet har hævdet, at sagen var forældet. Men sagen mod de danske myndigheder kan nu fortsætte, efter at Forsvarsministeriet mandag aften besluttede at acceptere Østre Landsrets afgørelse om, at sagen ikke er forældet.
